GTK data licence for theses

Terms and conditions for the use of products and data and related services in a thesis (Data Licence for Theses)

General

The Geological Survey of Finland (“GTK” or the “Licensor”) and, where applicable, its contractual partners are the producers of the products and materials covered by this Licence. GTK owns or controls the copyrights, database rights and other intellectual property rights necessary to license the Data. “User” means a student (“Student”) of an Educational organisation who uses the Data or related services under this Licence for the preparation of a Thesis.
This licence may only be used for licensing GTK Data for the preparation of theses.

Definitions:

• Thesis = A written, visual, digital or other work, including a final project, that compiles and demonstrates knowledge and competence acquired by the Student during their education.
• Educational organisation = A higher education institution or another educational institution in which the Thesis or final project is prepared.
• Student = A person carrying out a Thesis or other final project in an Educational organisation.
• Data = The GTK data, products and materials specified in the agreement, delivery documentation, order confirmation or other written communication from GTK. In this Licence, “Data” includes the original material provided by GTK and any part thereof.

Use of the Data for a thesis

GTK grants the Student a free-of-charge right to use fee-based Data as part of a Thesis prepared at an Educational organisation.
At its discretion, GTK may charge an extraction cost of the Data in accordance with its price list.

• The right to use is personal and only valid for the period required for the preparation and approval of the thesis.
• The thesis supervisor has the right to familiarise themselves with the Data when reviewing the thesis.
• The use of Data for any other purposes or for its further disclosure is not permitted without separate permission from GTK.
• Upon request, the Student must present the educational organisation’s confirmation of the thesis.

When using the Data, or in connection with any service that contains or utilises the Data or any part of it, a reference to the original source and the year of the Data version must be included:

or a mention of edits to the Data:

• [Name of specified data set or product], edited © Geological Survey of Finland Data Licence for Theses [year]

The Data must also be identified as either (a) unmodified or (b) edited.

By receiving Data or using services, the Student accepts the terms and conditions of this licence.

Licence terms

Unless otherwise expressly agreed in writing regarding the right to use the Data, or unless specific terms and conditions apply to a service through which the Data is provided or distributed, the right to use the Data is granted on the following terms:

Rights of use

This licence grants the Student a limited right to use the Data or service specified in the relevant Data agreement for the purpose of completing a thesis. The licence includes the requirements set by the educational organisation for publishing the thesis.

The right of use is granted free of charge and for a fixed term.

The right of use is non-exclusive and may not be transferred without GTK’s written permission.

Permitted use

Any presentations of the Data must include a reference to its source. In teaching activities and in the thesis, the use of images produced from the Data is permitted, provided that the source is referenced, and no separate permission is required.
If the thesis is prepared for or funded by a company, the use of the Data must be agreed separately with GTK.

Student’s responsibilities and liabilities

When using Data and any derivative products, the Student must:

• include a statement regarding GTK’s rights to the Data in accordance with the General section.
• take GTK’s Data and the associated rights of use into account in the data management plan of the thesis
• provide a copy of this Licence or a link to it

This licence agreement does not create a collaborative or business relationship between the Student and GTK. When using Data, the Student must not indicate that GTK endorses or recommends the Student´s use of the Data.

The Student is responsible for ensuring compliance with these licence terms, and the Student is obliged to protect the Data from use that violates these terms. The Student is liable for any loss or damage caused to GTK by the Student’s breach of these Licence terms.

When the right to use expires, the licensed Data must be destroyed.

Restrictions

The Student must comply with all Finnish and EU-level export restrictions as well as legislation pertaining to national security.

Use of the Data requires that the Student is not subject to sanctions imposed by the European Union or the United Nations. If GTK discovers that the Student or the relevant Educational Organisation was subject to such sanctions when the Data was received, or has subsequently become subject to such sanctions, GTK may immediately terminate the right to use the Data.

GTK’s responsibilities and limitation of liability

GTK confirms that it has the right to grant this licence for the Data covered by it.

The Data is licensed “as-is”, and GTK is not liable for any errors in the Data or service or for any direct or indirect damage caused by using the Data or service. GTK provides no guarantee that the Data or the information contained in it is accurate or up to date.

GTK provides no guarantee of continuous availability of the Data or the service, and GTK may terminate the distribution of the Data or the service without notice. The Student is not entitled to Data updates while the licence is valid.

The Data provided does not include personal data, or any included personal data has been anonymised in a manner appropriate for research data.

Applicable law

This licence is governed by Finnish law.

Changes to this licence

GTK may change the licence terms for distributed Data at any time or apply a different licence to the Data. However, the terms of this licence continue to apply to the Data that were used before changes to the licence.
